You are hereby given notice that the Division of Industrial Relations of the Department of Business and Industry, State of Nevada (Division) will conduct a public hearing on proposed permanent regulations amending Chapter 455C of the Nevada Administrative Code (NAC). The public hearing on these proposed regulations will be conducted by Webex on March 15, 2023 at 2:00 p.m. There is no physical location for this virtual meeting, as allowed by Nevada’s Open Meeting Law, NRS Chapter 241. Good Morning,
This email is to inform you of the progress related to the proposed ordinance amendment that would amend various provisions of LVMC Chapter 6.95 and Title 19.12 to include cannabis consumption lounges and repeals LVMC Chapter 6.96 in its entirety.
The bill was heard at the Recommending Committee meeting held on Monday, January 30th, 2023 and was approved as a First Amendment with the suggested amendments read at the Monday, January 17th, 2023 and Monday, January 30th, 2023 Recommending Committee meetings. Conditions:
All required licenses must be maintained in an active status without suspension or revocation throughout employment. Any employee may be required to stay at or return to work during public health incidents and/or emergencies to perform duties specific to this classification or to perform other duties as requested in an assigned response position. This may require working a non-traditional work schedule or working outside normal assigned duties during the incident and/or emergency.
New employees must complete Incident Command System training, ICS 100, ICS 200 and NIMS as a condition of continuing employment, prior to the completion of the probationary period.

The updated guidance supersedes previous Nevada Occupational Safety and Health Administration (Nevada OSHA) COVID-19 guidance released on May 20, 2022. This guidance has been updated in light of Governor Joe Lombardo’s Executive Order rescinding all COVID-19 related directives related to Governor Sisolak’s emergency declaration on March 12, 2020.
Because COVID-19 is a recognized health hazard in the workplace, employers continue to have a duty to protect their employees. Employers should evaluate the risk of COVID-19 in their workplace and incorporate an explanation of the methods used to identify, analyze, and control exposure to COVID-19 into the Written Safety Program required under NAC 618.540(1)(b).
While there are no State-specific requirements regarding COVID-19, the Federal requirements will remain in effect.

The bill was then heard at the Recommending Committee meeting on Tuesday, January 17th, 2023. The item was held in abeyance to Monday, January 30th, 2023.
As a result, please note there will be a hearing on the bill at the Recommending Committee meeting on Monday, January 30th, 2023 at 10 a.m. at City Council Chambers.

Did you know that OSHA penalties are going up?
In 2015, Congress passed the Federal Civil Penalties Inflation Adjustment Act Improvements Act to advance effectiveness of civil monetary penalties and to maintain their deterrent effect. Under the Act, agencies are required to publish "catch up" rules that adjust the level of civil monetary penalties and make subsequent annual adjustments for inflation no later than January 15 of each year.
This year, January 15 fell on a Sunday and January 16 was a federal holiday. Therefore the new OSHA penalty amounts became effective January 17, 2023.
OSHA's maximum penalties for serious and other-than-serious violations will increase from $14,502 per violation to $15,625 per violation. The maximum penalty for willful or repeated violations will increase from $145,027 per violation to $156,259 per violation.
